Acceptance of General Terms

By using Unelmaa products and services you agree to these General Terms and Privacy Policy. These terms are applicable to sale of products and services by Unelmaa. These Terms of Delivery are composed in accordance with the Finnish Consumer Protection Act (38/1978).

Land Ownership and Right of Possession

The agreement-based right of possession to Unelmaa piece of land means that the piece of land and its coordinates shall be registered under the landholder’s name in the Unelmaa landholding database and that the landholder is in permanent possession of the land area according these terms.

Unelmaa landholding database must as all times contain the valid contact information of each landholder. Landholders have the right to freely dispose of the land area, which means that the right of possession can be sold, donated or otherwise transferred to a third party. Unelmaa will charge a transfer fee for new registration. As the landholder you will receive for each land you own a unique possession keycode, which provides additional certainly regarding your ownership of the land. Keycode must be presented when transferring the land to a new owner.

You may buy a right of possession to a specified Unelmaa land area also as a gift.

The right of possession to any Unelmaa land area is fully based on agreement and is in no ways related to the rights provided in the Finnish Code of Real Estate (540/1995, as amended) or other legislation related to land areas and real estates. Unelmaa shall in no way be responsible for the changes, damages and losses that may occur due to eventual liquidation, bankruptcy, redevelopment, disassembling, expropriation or other such rearrangements of its functions or possessions.

Each Unelmaa piece of land is featured in the Unelmaa website. The corresponding land page stays as your own page, which you can modify according to Unelmaa rules. Unelmaa keeps the site up and updated for the period decided by Unelmaa. You may name your piece of land and Unelmaa will make the change on your land page.

Your right to use the land

As a landowner you have following rights:

- You may freely access and visit the land area as often as you like and with whom ever you like

- You may plant trees and new vegetation to your land.

- You may harvest your land and even cut down a tree on your own land.

- You may place a plaque or similar small physical item on your land.

- You may build a small treehouse, small hidden cottage or similar on your land.

- You have the right to for example walk, ski, cycle or drive a snowmobile or other such vehicle on your land areas; stay or set up camp temporarily on your Unelmaa land area; and pick wild berries, mushrooms, flowers or other natural products from all Unelmaa land areas.

As a landowner you have the following obligations and limitations:

- You must always respect the nature

- You must never ever pollute, litter or contaminate the land areas.

- You must not bury any dead. You may scatter cremated ashes on your land.

- You must always obey the laws and regulations in the area - everything prohibited by the then current law is prohibited. For this reason you must notify unelmaa in advance in case you plan to place visible items, build something, harvest or otherwise exploit your land. Unelmaa is happy to support your plans and give advice.

- You may not to use or register the land areas as a place of residence or build a house to live in. But you may build a treehouse or a hidden cottage. But contact us prior to such plans and we’ll discuss local regulations. And as always it should not be too visible and it should be in harmony with the nature.

Unelmaa shall in no way be liable for any claims by landholders in relation to the use of or the unability to use the Unelmaa land areas.

Full Satisfaction Policy

We hate to see you leave, but if you choose to do so, we will promptly return your money. We will ask you why, because we want to learn to serve you better. But no matter what you reason is, send us an email to support@unelmaa.com and your money will be returned in full.

The Full Satisfaction Promise is valid 30 days from your purchase.

Copyright Policy

Unelmaa is the owner of all copyrights of all contents of Unelmaa websites or Unelmaa is licensed by the owner of such copyrights to use all contents of Unelmaa websites.

By purchasing a Land you get full rights to use all photocopy materials taken from your land for personal use. Every registered user has the right to use, link, etc materials as long as they if they follow Fair Usage Rights.

Landholders have the right to share, transfer, distribution or storage of part or all of the contents in any form without the prior written permission of Unelmaa in accordance with these General Terms. Unelmaa has the right to cancel this right at any time.

The use and content of the Unelmaa website is permitted for private use only. If you wish to use our copyright materials for commercial purposes you should apply for a consent thereto in writing from Unelmaa.

The use of press releases and other documents classified as public is permitted, if the source for such information has been stated when such information is being used.

If you use the Unelmaa websites, the content therein or our products and services for commercial purposes, you agree to indemnify and hold harmless Unelmaa and its officers, directors, employees and agents, from and against any claims, suits, proceedings, disputes, demands, liabilities, damages, losses, costs and expenses, including and without limitation to reasonable legal and accounting fees (including costs of defense of claims, suits or proceedings brought by third parties), in any way related to your access to the Unelmaa websites or the content therein or use of our products and services or your breach of any of these General Terms.

Submitting Material to Unelmaa.com

By submitting material to Unelmaa you agree: that the material will not contain any material that is unlawful, abusive, threatening, vulgar or otherwise unfit for publication; that the material will not violate the privacy or other rights of another person or entity; the material is not false, misleading, or inaccurate; you own the material or have the unlimited right to provide it to us and Unelmaa may publish the material free of charge and/or incorporate it or any concepts described in it in our products without accountability or liability; you agree not to take action against us in relation to material that you submit and you agree to indemnify us if any third party takes action against us in relation to the material you submit; you will not submit Unelmaa any spam, junk mail or other unauthorized mass-communication; and you will use reasonable efforts to scan and remove any viruses or other contaminating or destructive features before submitting any material to Unelmaa. Unelmaa may at any time remove any content posted by users. Unelmaa do not and cannot review the content posted by users on the Unelmaa websites and is not responsible for such content. Order and Order Confirmation

Unelmaa products and services may be bought in Unelmaa web site and via authorized retailers. General Terms and Conditions (as amended from time to time) shall establish the legally binding terms and conditions for purchasing Unelmaa products and services.

As soon as your order has been received by Unelmaa, an order confirmation will be sent to you by email. The decision to accept an order shall be made at the sole discretion of Unelmaa. If an order shall not be executed, Unelmaa will inform you thereof immediately by email.

Price and Payment

All prices specified by Unelmaa contain the relevant Finnish VAT. The prices are in Euros. The purchase price is a one-time only payment. There are no other costs associated with buying or owning Unelmaa land. You will have no further expense to pay after the initial purchase price.

Unelmaa reserve the right to change, review and update the prices, payment methods and alter or remove offers as needed. The payment is to be made through PayPal payment system. By making the payment you shall be subject to any and all relevant terms and conditions set by PayPal. Unelmaa shall accept no liability for any costs or other damage you or any third parties may incur as a result of malfunctioning of the PayPal payment system and/or your misusage of the PayPal payment system.

Unelmaa shall not and cannot cover any costs that you may incur from national legislation in the state of your residence or nationality or the state of residence or nationality of the recipient, including but not limited to all taxes, custom duties, redemption payments or other such payments or costs. By accepting these Terms of Delivery you agree to cover any and all such expenses. In addition, you also agree that you will cover the additional payment related costs for electronic transfers or service charges that result from the agreements you may have with your credit institute or other institutions.

Permanent ownership

Your ownership of land in Unelmaa is permanent. Unelmaa will be the registered owner in Finnish government registries and Unelmaa will take care of statutory payments, forest maintenance fees and applicable taxes. These payments are subject to change according to Finnish legislation. Unelmaa has reserved funds for paying all fees related to the whole area.

Website User Account

Creating a user account in www.unelmaa.com is a prerequisite for making a land purchase. Registering as a new user as such does not cost you anything and makes no obligation to purchase anything.

Either Unelmaa or you may terminate your website user account without a specified reason. If your website user account is being terminated, Unelmaa will inform you thereof to the email address you have given.

No-Waiver

Unelmaa have made every effort to ensure that these General Terms adhere strictly with Finnish Law. In the event that any of the terms of these General Terms would be found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions.

In the event that any part of these General Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

Security

Unelmaa is committed to work for protecting the security of the Unelmaa websites and your user account. However, we cannot guarantee that third parties are not able to defeat our security measures. You agree to inform us immediately if you suspect any third party having used your account or the Unelmaa websites illicitly.

Territorial Restrictions

The information provided in the Unelmaa websites is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject Unelmaa to an obligation to register within such jurisdiction or country.

We reserve the right to limit the availability of the Unelmaa websites, our products and services to any persons, geographic area, or jurisdiction, at any time and in our sole discretion, and to limit the applicability or quantity of any content, product or service we provide.

Changes to General Terms

Unelmaa may from time to time change these General Terms or change, modify or withdraw access to the Unelmaa websites at any time with or without notice. The most current version of these General Terms will always be posted on the Unelmaa websites with the date of latest revision after the original General Terms. By continuing to access or use the Unelmaa websites, products and services after revisions become effective, you agree to be bound by the revised General Terms

These General Terms, and any rights and licenses granted hereunder, may be assigned by Unelmaa without restriction.

Force Majeure

Unelmaa shall not be responsible for delivery being prevented, impeded or delayed for reasons beyond its control, such as war, natural catastrophes, export or import embargos, the rulings of authorities, strikes and lockouts, mail delivery failure, fire, currency restrictions, import and export restrictions, disturbance in general traffic and communications or other similar reasons impeding or preventing Unelmaa or a party acting of behalf of them from operating. In connection with said circumstances, Unelmaa shall be entitled to cancel the order, or to deliver the products when the obstacle no longer exists.

Limitation of Liability

Unelmaa shall not be liable to you or any other party for any loss or damage whatsoever or howsoever, directly or indirectly, caused by or arising in connection with Unelmaa products, services or website, except to the extent to which it is unlawful to exclude such liability under the applicable law. Except for any liability of Unelmaa not able to be excluded at law, the liability of Unelmaa shall not exceed fifty percent (50%) of the net amount actually paid to Unelmaa in respect of the products or services, which gave rise to the liability in question.

Unelmaa reserve the right to revise the web sites or withdraw access to them at any time. No warranty of any kind is made in relation to the availability, accuracy, reliability or content of Unelmaa web sites.

Entire agreement

These General Terms for use of Unelmaa products and services as amended from time to time shall constitute the entire agreement between you and Unelmaa. If any provision of these General Terms is deemed invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these General Terms shall remain in full force and effect.

Governing Law and Dispute Resolution

These General Terms are governed by and construed in accordance with the laws of Finland, without giving effect to any principles of conflicts of law. All disputes or discords arising from the content of these Terms of Delivery shall be resolved in Finland in accordance with Finnish law.
